Construction & Procurement

The Firm's construction and procurement law section assists clients in minimizing risks and maximizing advantages through the drafting and reviewing of construction or design contracts, provision of advice during the design, bid and construction phases, and negotiation of disputes or claims among project participants. In addition, the Firm's members have developed extensive experience in litigating construction or bid protest claims in federal and state courts, as well as before arbitration panels. The firm represents a variety of general contractors, subcontractors, suppliers, owner/developers, architects and engineers throughout the state. Members of the Firm frequently publish works and lecture on the subjects of construction law, public works law, lien and bond law and construction delivery systems.

Retained by the Alabama AGC (Associated General Contractors), the Firm drafted and facilitated passage in 1997 of the most comprehensive reform legislation in the history of Alabama competitive bid law. The Firm is frequently consulted by both business and government on various procurement challenges, and has successfully guided joint public-private developments. On the leading edge of construction delivery systems, the Firm has developed customized and innovative contract forms suitable for industrial, health care or other facilities. With the building of Hyundai and Kia automobile manufacturing facilities in central Alabama and west Georgia, the Firm has been retained on a number of projects for the design/construction of manufacturing facilities for first and second tier suppliers to Hyundai and Kia.

Often retained by the state's construction oversight agency, the Alabama Building Commission, the firm accomplished a massive rewrite of the general conditions, forms and procedures used on public contracts throughout the state. It has also advised the General Contractors Licensing Board on occasion, and frequently assists contractors in obtaining or protecting their license.

When getting paid or getting performance is the name of the game, the Firm regularly handles claims involving surety bonds issued for the construction industry. Firm members have extensive experience in bringing and defending bond claims asserted under the Federal Miller Act, Alabama's Little Miller Act, and bonds written for the private sector. It has equal experience in the prosecution and defense of mechanics and materialmen's liens that secure payment for work done.
