10/16/2009 - Alabama Supreme Court rules in favor of Capell & Howard's client in drug price case
On October 16, 2009, the Alabama Supreme Court reversed $274 million in judgments entered in favor of the State of Alabama against three pharmaceutical companies, including Capell & Howard's client Novartis Pharmaceuticals Corporation, and directed the judgment be entered for the pharmaceutical companies. The State alleged that the pharmaceutical companies overcharged the State for prescription drugs for Medicaid recipients from 1991 through 2005. The Alabama Supreme Court ruled that the evidence presented by the pharmaceutical companies belied the State's fraud claims and held that the trial court erred in refusing to grant the pharmaceutical companies' motions for judgment as a matter of law. Novartis was represented in the trial and appeal by Capell & Howard attorneys Bill Coleman and Jimmy Walter.
