
The Capell & Howard Health Care Practice group has a deep tradition from which it has developed a broad practice. The firm was instrumental in the formation of the Alabama Medicaid Agency in 1975. As its general counsel and litigation counsel, we guided the agency in its formative years through the intricacies of the federal and state regulatory bureaucracies. With that experience, we have developed a provider-oriented practice representing professionals and health care facilities in business, employment, and regulatory matters.
Specific to health law, our attorneys handle certificates of need, state and federal certification and licensure matters, deficiency surveys, disciplinary proceedings, fraud and abuse issues including Stark and Anti-Kickback compliance matters, HIPAA claims, and other regulatory compliance.
Our attorneys regularly handle corporate transactions for health care clients, including mergers and acquisitions, taxable and tax-exempt bond financing, structuring of physicians practices and health care facilities, negotiating managed care contracts, negotiating professional employment contracts, and providing regular business and employment counsel.
